All users of this site agree that access to and use of this site is subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

Please note that: Our office will be closed Saturday, December 23 through Monday, January 1 for Holiday Season. All orders received after Wednesday December 20th 2019 by 1:00pm EST will be processed on Tuesday January 2nd 2020. 

Clicking the checkbox, the customer consents to Equiwin, Inc. to accept and keep the order in hold for this period to start the process of the order starting on Tuesday January 2nd 2018.

Typographical Errors
In the event that a Equiwin, Inc. product is mistakenly listed at an incorrect price, Equiwin, Inc. reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Equiwin, Inc. reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Equiwin, Inc. shall issue a credit to your credit card account in the amount of the incorrect price.


Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Equiwin, Inc. without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Sales Tax

Only Shipments to Florida (FL) are subject to sales tax. If you are a reseller and would like to have your sales tax waived, please fill out the Resale Certificate Form, reference your order number and send through fax number +1.305.9947689, together with a copy of your Seller’s Permit.

Shipping

After placing your order you will receive a confirmation e-mail with details of the order you just placed. Also included in your confirmation e-mail is important information regarding your order and guidelines pertaining to your order.

At the time of publication, all merchandise is scheduled to be in stock in our warehouse or factory’s warehouses. However, since high demand can sometimes cause backorders. Most orders placed before 11:00 am EST, can be shipped the same day that we receive them, nevertheless the customer allows us to ship the order within 2 business days after it has been placed, (Monday to Friday, 9 am to 5 pm EST). Some orders may require six (6) weeks, depending on availability.

Orders are shipped via USPS, UPS, FEDEX, or other freight forwarders. Shipments to Alaska and Hawaii residents must be shipped 2-day air. Items in Stock will be shipped to you from the closest of more than 10 affiliated manufacturers across the USA.

Special Orders

Most products are hand made and Equiwin, Inc., may require up to six (6) weeks to receive the merchandise and ship it to you.
  

Warranty and Returns

Equiwin, Inc., does not issue money-back. In case of a necessary return, a store credit for the return will be issued to the customer’s Equiwin account.

All Clearance sales are final, no exceptions.

Equiwin, Inc., does not take back or exchange merchandise unless of course, you have received a damaged or defective item. Equiwin, Inc., will exchange it for a new item for the first 30 days from the date of purchase, this policy assures be each customer he/she will be receiving only new factory products from us. Equiwin, Inc., never sells items that have been opened or used before unless stated otherwise. Non-defective merchandise returned for any reason other than a miss-ship of product, damage, or defectiveness will be subject to a 30% restocking fee.

All/any special order is a final sale and cannot be returned or exchanged under any circumstances other than error in the personalization(s)/customization(s) requested.

Special Orders consist of all/any personalization(s) including name/initial embroideries, monogram additions, custom designs, and/or any customizations that alters the product’s original factory design.

Customer is responsible for return shipment of the defective product.

When purchasing a product like a  saddle from Equiwin, Inc., you are allowed 7 days for notification of return if the saddle does not fit the rider or horse. Please, return the product immediately, unused, for exchange or refund. We stress that a full refund can only be given if the product is absolutely clean and shows no evidence of use and it will be given as a store credit for online purchases.

Shipping and handling fees are not refundable. A return authorization number ( RMA# ) must be obtained by Equiwin, Inc., prior to the return. Customers have 30 days after the RMA is approved to return merchandise to our facilities. Merchandise that is shipped back to us without an RMA number on the outside of the shipping box or after the 30-day RMA deadline will not be accepted.

My package was damaged during transit?

• If your package arrived damaged and the shipping company caused it, please refuse the delivery of the package so that it will be returned to us. Please then advise us immediately that you have refused the package. Please E-mail returns@Equiwin.comwith your original order number after you have refused the package.
• If you were unable to refuse the delivery, please call the courier company that delivered you the package and ask them to pick up the damage package. Make sure you get a receipt for the pickup. Advise us via E-mail (returns@Equiwin.com) and provide us with your original order number.
• When you advise us via E-mail of the damage package, please indicate if you want immediate replacement. For replacement, we can only send you a replacement once the courier company has picked up the damage product.

Notice
Equiwin, Inc. may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Equiwin, Inc..


Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of Florida, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Equiwin, Inc. products) shall be in the state or federal courts located in Miami-Dade County, Florida. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Equiwin, Inc. products) must be commenced within one (1) year after the claim or cause of action arises. Equiwin, Inc.’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Equiwin, Inc. may assign its rights and duties under this Agreement to any party at any time without notice to you.


Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Equiwin, Inc. or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.


Participation Disclaimer
Equiwin, Inc. does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Equiwin, Inc. is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site.
